Welcome to HayPost USA. These Terms & Conditions ("Terms") govern your access to and use of the HayPost USA website, customer portal, and all shipping and related services provided by HayPost USA Inc. ("HayPost USA," "we," "our," or "us").

By accessing our website, creating an account, requesting a shipment, making a payment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use our website or services.

1. OUR SERVICES

HayPost USA provides international shipping, international parcel forwarding, mail forwarding, package consolidation, packaging services, shipment tracking, customs processing assistance, insurance options, payment processing, and other related logistics services.

HayPost USA specializes in shipping between the United States and international destinations, including Armenia.

Transit times published on our website are estimates only and are not guaranteed unless expressly stated in writing.

Delivery times may be affected by customs inspections, airline schedules, weather conditions, government actions, security screenings, holidays, labor disputes, or other events beyond our reasonable control.

HayPost USA reserves the right to modify, suspend, or discontinue any service at any time to comply with applicable laws, carrier requirements, operational needs, or safety and security regulations. Existing shipments accepted prior to any such changes will continue to be handled in accordance with these Terms & Conditions.

2. CUSTOMER ACCOUNTS

Customers may create an online account to manage shipments, receivers, payments, and tracking information.

You agree to:

Provide accurate, complete, and current information.
Keep your contact information up to date.
Protect your username and password.
Notify HayPost USA immediately if you believe your account has been accessed without authorization.

HayPost USA reserves the right to suspend or terminate any account that contains false information, is used fraudulently, or violates these Terms & Conditions.

3. PAYMENT TERMS

Payment is required before shipment unless other arrangements have been approved in writing by HayPost USA.

We accept approved credit cards, debit cards, ACH payments, and other payment methods displayed on our website.

By submitting payment information, customers represent that they are authorized to use the selected payment method and authorize HayPost USA and its payment-processing providers to process the applicable charges.

Customers are responsible for ensuring that all payment and billing information is complete, accurate, and authorized.

Returned payments, chargebacks, declined transactions, unpaid balances, or fraudulent payment activity may result in shipment delays, suspension of services, additional fees, collection efforts, or cancellation of shipments.

Customers remain responsible for all shipping charges, customs duties, taxes, storage fees, government charges, and any additional costs incurred in connection with their shipment.

Prices, shipping rates, and service fees may change from time to time. The applicable price will be the price disclosed to and accepted by the customer at the time the transaction is completed.

4. SHIPPING SERVICES

HayPost USA provides international transportation and logistics services for packages accepted through our offices, authorized partners, and approved remote shipping programs.

Transit times shown on our website are estimates only and are not guaranteed unless expressly agreed to in writing.

Delivery may be delayed due to customs inspections, airline schedules, weather conditions, government actions, security screenings, labor disputes, force majeure events, incorrect shipment information, recipient availability, or other circumstances beyond our control.

HayPost USA shall not be liable for delays resulting from any of these circumstances.

5. CUSTOMER RESPONSIBILITIES

Customers are responsible for ensuring that:

Shipment information is complete and accurate.
Customs declarations are truthful.
Shipment values are correctly declared.
Package contents comply with all applicable laws and regulations.
The recipient is legally permitted to receive the shipment in the destination country.

Customers remain solely responsible for any customs duties, taxes, import fees, government assessments, storage charges, penalties, or other charges imposed by customs authorities.

6. PROHIBITED ITEMS

Customers agree not to ship any item prohibited by United States law, the laws of the destination country, airline regulations, carrier requirements, or HayPost USA policies.

Prohibited items include, but are not limited to:

Explosives
Firearms
Ammunition
Hazardous materials
Flammable liquids
Illegal drugs
Counterfeit goods
Dangerous chemicals
Radioactive materials
Restricted medications
Any item prohibited by U.S. Customs or destination country customs authorities

HayPost USA reserves the right to refuse, inspect, delay, return, or report prohibited shipments to the appropriate authorities without prior notice, subject to applicable law.

7. CUSTOMS CLEARANCE

International shipments are subject to inspection by customs authorities.

HayPost USA cannot guarantee customs clearance or delivery within any specific timeframe.

Customs authorities may inspect, delay, seize, return, or destroy shipments in accordance with applicable laws.

Customers are solely responsible for providing complete and accurate customs documentation.

Any customs duties, taxes, examination fees, storage charges, penalties, or other government assessments remain the responsibility of the customer.

8. INSURANCE

Unless otherwise stated, shipments may include limited complimentary insurance coverage as described on our website.

Additional insurance may be available for eligible shipments.

Insurance does not cover losses resulting from:

Improper packaging
Prohibited or restricted items
Customs inspections or government actions
Normal wear and tear
Delays in transportation
Force majeure events
Incorrect shipment information provided by the customer

Insurance claims must be submitted within the timeframes specified in our Refund Policy.

9. INTELLECTUAL PROPERTY RIGHTS

All content available through the HayPost USA website and customer portal, including but not limited to the HayPost USA name, logos, trademarks, trade names, text, graphics, photographs, images, designs, software, website layout, and other materials, is owned by or licensed to HayPost USA and/or its affiliates and is protected by applicable intellectual property laws.

Customers and website users may use our website and its content solely for personal and lawful use in connection with HayPost USA services.

No HayPost USA content, trademarks, logos, designs, or other intellectual property may be copied, reproduced, modified, distributed, published, displayed, sold, licensed, or commercially used without prior written authorization from HayPost USA or the applicable rights holder.

Unauthorized use of HayPost USA intellectual property may result in suspension or termination of access to our services and may subject the responsible party to remedies available under applicable law.

Falsify customs declarations, shipment values, sender information, recipient information, or descriptions of package contents.
Ship prohibited, illegal, dangerous, hazardous, restricted, or improperly declared items.
Use another person's identity, account, or payment information without authorization.
Engage in fraudulent transactions, fraudulent claims, or knowingly improper chargebacks.
Attempt to gain unauthorized access to our website, customer accounts, systems, networks, or data.
Introduce viruses, malicious software, or other harmful technology into our systems.
Interfere with or disrupt our website, customer portal, or services.
Use HayPost USA services in connection with illegal, fraudulent, abusive, or unauthorized activity.
Infringe the intellectual property, privacy, or other legal rights of HayPost USA or any third party.

If a customer violates these Terms, HayPost USA may, as appropriate and subject to applicable law, refuse or cancel a shipment, suspend or terminate an account, require additional documentation, return a shipment, refuse future services, recover amounts legitimately owed, or report suspected illegal activity to the appropriate authorities.

Customers remain responsible for charges, costs, penalties, or damages resulting from their violation of these Terms or applicable shipping and customs requirements to the extent permitted by law.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HayPost USA shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of our website, customer portal, shipping services, or related services, including loss of profits, business, data, opportunity, or other economic losses.

HayPost USA is not responsible for loss, damage, delay, seizure, return, additional costs, or failure of delivery resulting from circumstances beyond our reasonable control, including but not limited to:

Customs inspections or actions
Government actions or regulatory requirements
Airline or carrier delays
Weather conditions or natural disasters
Security screenings
Labor disputes
Force majeure events
Incorrect or incomplete information supplied by the customer
Prohibited or improperly declared shipment contents
Acts or omissions of the sender or recipient

Liability for lost or damaged shipments is subject to the applicable insurance coverage, declared value, exclusions, documentation requirements, and claim limits described in these Terms, our Refund Policy, and any applicable shipping documentation.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

12. DISPUTE RESOLUTION

Customers are encouraged to contact HayPost USA directly regarding any dispute, billing issue, shipment problem, refund request, or claim so that we have an opportunity to investigate and attempt to resolve the matter.

If a dispute cannot be resolved directly between the customer and HayPost USA, the parties may attempt to resolve the dispute through good-faith negotiation or mediation.

If the matter remains unresolved, either party may pursue arbitration if mutually agreed or bring the matter before a court of competent jurisdiction, subject to applicable law.

Nothing in this section prevents a customer from exercising rights or remedies that cannot legally be waived under applicable consumer-protection laws.

13. GOVERNING LAW

These Terms & Conditions and any dispute arising from or relating to the use of HayPost USA's website, customer portal, shipping services, payments, or other services shall be governed by and interpreted in accordance with the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles.

Unless otherwise required by applicable law, any legal proceeding arising from these Terms or HayPost USA services shall be brought before a court of competent jurisdiction in California.

14. SUSPENSION AND TERMINATION

HayPost USA reserves the right to suspend, restrict, or terminate a customer's account or access to services if we reasonably believe that the customer:

Has violated these Terms & Conditions.
Has provided false or fraudulent information.
Has attempted to ship prohibited or illegal items.
Has engaged in fraudulent payment activity.
Has failed to pay amounts legitimately owed.
Has misused our website, customer portal, or services.
Has engaged in conduct that creates a legal, regulatory, security, or safety risk.

Where appropriate, HayPost USA may also refuse future shipments or require additional verification before providing additional services.

Termination or suspension does not eliminate the customer's responsibility for outstanding amounts or obligations incurred before termination.

15. CHANGES TO THESE TERMS

HayPost USA may update these Terms & Conditions from time to time to reflect changes in our services, operational requirements, payment practices, applicable laws, or regulatory requirements.
